Section 02
The User acknowledges that the Company provides professional digital and technological services, including but not limited to:
- Consultancy: Business consultancy and management services in the field of advertising and marketing.
- Software & Web Development: Design, creation, development, management, and maintenance of IT platforms, interface systems, information systems, and software.
- Web Portals: Creation and management of websites, internet portals, and web search portals.
- E-commerce: Buying and selling products through the internet.
Section 03
- Acceptance: The contract is considered finalized when the User receives formal confirmation of the order or upon successful payment.
- Payment Methods: Payments for digital services and e-commerce transactions are processed through secure integrated platforms.
- Outsourcing: The Company reserves the right to outsource technological platforms or information systems to fulfill service requirements.
Section 04
Pursuant to the Italian Consumer Code, the right of withdrawal (typically 14 days) is subject to specific limitations for digital services:
- Service Fulfillment: The right of withdrawal cannot be exercised once the service has been fully performed if the execution began with the consumer's express prior consent.
- Digital Content: For the supply of digital content not provided on a tangible medium, the right of withdrawal is waived once the download or streaming has begun.
Section 05
- Ownership: All intellectual property rights related to software, platforms, source codes, logos, and content developed or managed by FIORE'S DIGITAL SERVICES S.R.L. remain the exclusive property of the Company unless otherwise agreed upon in writing.
- Restrictions: Unauthorized reproduction, modification, or distribution of these materials is strictly prohibited.
Section 06
- Service Interruptions: The Company is not liable for indirect damages or service interruptions caused by third-party hosting providers, technical failures, or force majeure.
- Administrative Powers: The Sole Director is vested with all powers for ordinary and extraordinary management to ensure the achievement of the corporate object.
Section 07
- Applicable Law: This Contract is governed exclusively by Italian Law.
- Jurisdiction: Any dispute arising from the interpretation or execution of this Contract shall be submitted to the exclusive jurisdiction of the Court of Naples (Napoli).
